1. Agreement to Terms

By accessing or using AI Content Poster ("the Service"), operated by AI Content Poster ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

AI Content Poster is an AI-powered content creation and marketing platform that provides tools for generating blog posts, social media content, video scripts, sales letters, AI-generated images, AI-narrated videos, and content scheduling. The Service uses artificial intelligence models including OpenAI and ElevenLabs to generate content on behalf of users.

3. User Accounts

To use certain features of the Service, you must create an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain the security of your account credentials and not share them with third parties.
  • Accept responsibility for all activities that occur under your account.
  • Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4. Credits, Subscriptions, and Billing

The Service operates on a credit-based system. Credits are consumed when you use AI-powered features such as content generation, image creation, video production, and sales letter writing. Credit costs vary by feature and are displayed before each action.

  • Free Tier: New accounts receive a limited number of credits per month at no charge.
  • Paid Subscriptions: Paid plans provide additional credits and features on a monthly or annual billing cycle. Subscriptions are processed through Stripe and auto-renew unless cancelled.
  • Credit Packs: One-time credit purchases are non-refundable once consumed.
  • Cancellation: You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period. No prorated refunds are provided for partial billing periods.

5. Acceptable Use

You agree not to use the Service to:

  • Generate content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
  • Create spam, misleading content, or content designed to deceive or defraud others.
  • Violate any applicable local, state, national, or international law or regulation.
  • Infringe upon the intellectual property rights of any third party.
  • Attempt to gain unauthorized access to other users' accounts or to the Service's infrastructure.
  • Use automated scripts, bots, or other means to access the Service in a manner that exceeds normal usage patterns.
  • Reverse engineer, decompile, or disassemble any part of the Service.

6. AI-Generated Content

Content generated through the Service is produced by artificial intelligence models. You acknowledge and agree that:

  • AI-generated content may not always be accurate, complete, or suitable for your intended purpose. You are responsible for reviewing and editing all generated content before publishing or distributing it.
  • You retain ownership of the prompts and inputs you provide to the Service.
  • Subject to your compliance with these Terms, you are granted a non-exclusive, worldwide license to use, modify, and distribute content generated through the Service for your personal or commercial purposes.
  • We do not guarantee that AI-generated content is free from errors, biases, or intellectual property concerns. You are solely responsible for ensuring that your use of generated content complies with applicable laws.
  • Similar or identical content may be generated for other users who provide similar prompts.

7. Social Media Integration

The Service allows you to connect third-party social media accounts (such as TikTok and Instagram) for direct content publishing. By connecting your social media accounts, you authorize us to post content on your behalf as directed by you. You remain solely responsible for all content published to your social media accounts through the Service, and you agree to comply with each platform's terms of service and community guidelines. We are not liable for any consequences arising from content posted to your social media accounts.

8. Intellectual Property

The Service, including its original content (excluding user-generated and AI-generated content), features, and functionality, is and will remain the exclusive property of AI Content Poster and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the data practices described in our Privacy Policy.

10. Third-Party Services

The Service integrates with third-party services including OpenAI, ElevenLabs, Stripe, TikTok, and Instagram/Meta. Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or reliability of third-party services, and we make no warranties regarding their performance.

11. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE RESULTS OBTAINED FROM USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AI CONTENT POSTER, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY CONTENT OBTAINED FROM THE SERVICE; AND (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to defend, indemnify, and hold harmless AI Content Poster and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including but not limited to content you generate, publish, or distribute using the Service.

14. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.
